EMINENT DOMAIN
Deuteronomy 10

14 Indeed heaven and the highest heavens belong to the Lord your God, also the earth with all that is in it.
Psalms 24

1 The earth is the Lord’s, and all its fullness, The world and those who dwell therein.
Many leaders in the Church have a “mystical”, literal interpretation of these scriptures. I also had this understanding about 20 years ago. When I began the ministry I worked with some of our families in a mountainous region. The spirit of the Lord told me to erect a Cross on top of the mountain. I gathered the brothers and proceeded to build the Cross as I was led by the Lord. During the construction, a man came up the mountain and he was very angry. He asked me who gave me permission to erect a Cross on his property. It was an embarrassing moment for me in the presence of all the brothers from the church. I learnt an important lesson on that day.
The earth is the Lord’s, but it has been placed in the hands of men. We must understand the Law of Eminent Domain. There are legal consequences of land invasion and illegal occupation of property.
What is Eminent Domain?

Eminent domain is the power of the state to take private property for the use in a public project in return for reasonable compensation. Reasonable compensation is defined in terms of fair market value of the property.
David understood this law perfectly.
2 Samuel 24

21 Then Araunah said, “Why has my lord the king come to his servant?” And David said, “To buy the threshing floor from you, to build an altar to the Lord, that the plague may be withdrawn from the people.” 22 Now Araunah said to David, “Let my lord the king take and offer up whatever seems good to him. Look, here are oxen for burnt sacrifice, and threshing implements and the yokes of the oxen for wood. 23 All these, O king, Araunah has given to the king.” And Araunah said to the king, “May the Lord your God accept you.” 24 Then the king said to Araunah, “No, but I will surely buy it from you for a price; nor will I offer burnt offerings to the Lord my God with that which costs me nothing.” So David bought the threshing floor and the oxen for fifty shekels of silver.

Thousands of years ago kings who were absolute monarchs practiced the Law of Eminent Domain. David refuse to use his position and authority to colonise the threshing floor of Araunah.
Ahab, a wicked King, demonstrated the same attitude towards the vineyard of Naboth.
1 Kings 21

Naboth Is Murdered for His Vineyard

1 And it came to pass after these things that Naboth the Jezreelite had a vineyard which was in Jezreel, next to the palace of Ahab king of Samaria. 2 So Ahab spoke to Naboth, saying, “Give me your vineyard, that I may have it for a vegetable garden, because it is near, next to my house; and for it I will give you a vineyard better than it. Or, if it seems good to you, I will give you its worth in money.” 3 But Naboth said to Ahab, “The Lord forbid that I should give the inheritance of my fathers to you!”

Ahab offered Naboth a good price for his vineyard or a better vineyard. Because Naboth refused, he was murdered by the wicked King Ahab after he was influenced by his evil wife Jezebel. The ministry of your brother belongs to God; but the Lord, our God has placed the ministry in the jurisdiction of your brother.

1 Do Senhor é a terra e a sua plenitude; o mundo e aqueles que nele habitam.
Muitos líderes da Igreja têm “mística”, interpretação literal dessas escrituras. Eu também tive esse entendimento cerca de 20 anos atrás. Quando comecei o ministério eu trabalhei com alguns dos nossos famílias em uma região montanhosa. O espírito do Senhor me disse para erguer uma cruz no topo da montanha. Juntei os irmãos e começou a construir a cruz como eu fui conduzido pelo Senhor. Durante a construção, um homem veio até a montanha e ele estava muito irritado. Ele me pediu que me deu permissão para erigir uma cruz em sua propriedade. Foi um momento embaraçoso para mim na presença de todos os irmãos da igreja. Eu aprendi uma lição importante naquele dia.
A terra é do Senhor, mas tem sido colocada nas mãos dos homens. Devemos entender a Lei de domínio eminente. Existem consequências jurídicas da invasão e ocupação do solo ilegal de propriedade.
O que é domínio eminente?

Domínio eminente é o poder do Estado para tomar a propriedade privada para o uso em um projeto público, em troca de uma compensação razoável. compensação razoável é definido em termos de valor de mercado do imóvel.
David compreendeu esta lei perfeitamente.
2 Samuel 24

21 Perguntou Araúna: Por que vem o rei meu senhor ao seu servo? Respondeu Davi: Para comprar de ti a eira, a fim de edificar nela um altar ao Senhor, para que a praga cesse de sobre o povo.   22 Então disse Araúna a Davi: Tome e ofereça o rei meu senhor o que bem lhe parecer; eis aí os bois para o holocausto, e os trilhos e os aparelhos dos bois para lenha.   23 Tudo isto, ó rei, Araúna te oferece. Disse mais Araúna ao rei: O Senhor teu Deus tome prazer em ti.   24 Mas o rei disse a Araúna: Não! antes to comprarei pelo seu valor, porque não oferecerei ao Senhor meu Deus holocaustos que não me custem nada. Comprou, pois, Davi a eira e os bois por cinqüenta siclos de prata.

Milhares de anos atrás reis que estavam monarcas absolutos praticado a lei de domínio eminente. David se recusam a usar sua posição e autoridade para colonizar a eira de Araúna.
Acabe, um rei mau, demonstraram a mesma atitude em relação à vinha de Nabote.

Naboth é assassinado para a sua vinha

1 Sucedeu depois destas coisas que, tendo Nabote, o jizreelita, uma vinha em Jizrreel, junto ao palácio de Acabe, rei de Samária,   2 falou este a Nabote, dizendo: Dá-me a tua vinha, para que me sirva de horta, porque está vizinha, ao pé da minha casa; e te darei por ela outra vinha melhor; ou, se desejares, dar-te-ei o seu valor em dinheiro.   3 Respondeu, porém, Nabote a Acabe: Guarde-me o Senhor de que eu te dê a herança de meus pais.

Acabe ofereceu Naboth um bom preço para a sua vinha ou uma melhor vinha. Porque Nabote recusou, ele foi assassinado pelo ímpio rei Acabe depois que ele foi influenciado por seu mal esposa Jezabel. O ministério de seu irmão pertence a Deus; mas o Senhor, nosso Deus colocou o ministério na jurisdição do seu irmão.

Deus abençoe todos vocês.
